Distance Sales Agreement

1. Parties
1.1. SELLER (Service Provider)

1.2. BUYER: The person who makes a booking on the website and whose name, email address and phone number are given in the booking form. The BUYER's details appear in the booking record and the booking confirmation.
2. Subject
This agreement sets out the rights and obligations of the parties regarding the sale and performance of the service the BUYER books electronically on the SELLER's website, in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
3. Main Characteristics of the Service
The SELLER provides the following services with chauffeured vehicles:
- Private (VIP) transfers between airports, hotels and addresses, one way or return,
- Hourly chauffeured car hire,
- Day tours, guided or unguided.
The pick-up and drop-off points, date, time, vehicle type, number of passengers, selected extras and total price are chosen by the BUYER during booking, shown as a summary before the payment step and included in the booking confirmation. These details form an integral part of this agreement.
4. Price and Payment
4.1. The price is the total amount shown during booking in the currency chosen by the BUYER, including all taxes and any bridge or motorway tolls. The price shown at booking is fixed; as long as the route and scope of the service stay as booked, no extra charge is requested afterwards.
4.2. If the BUYER asks for a route change, an extra stop or extra time during the journey, the additional cost is communicated to the BUYER beforehand and applied only with the BUYER's consent.
4.3. Payment is made by the method the BUYER chooses during booking: in cash in the vehicle on the day of service, or by credit/debit card on the website.
4.4. Card payments are taken through the 3D Secure payment infrastructure of the contracted bank. The SELLER neither sees nor stores card details.
4.5. The SELLER is not responsible for exchange-rate differences, commissions or similar charges applied by the bank that issued the BUYER's card.
5. Performance of the Service
5.1. The service is performed on the date, at the time and at the meeting point stated in the booking. For airport pick-ups the driver meets the BUYER with a name sign.
5.2. If the BUYER has provided a flight number, the SELLER tracks the flight and adjusts the pick-up time for delays. In that case the driver waits up to 60 minutes after landing.
5.3. If no flight number was provided and the BUYER cannot be reached by the phone number or email given, the driver waits 30 minutes from the booked time.
5.4. If, after these waiting times, the BUYER has not come to the meeting point and cannot be reached, the service is deemed not performed for reasons attributable to the BUYER (no-show).
6. Obligations of the Parties
6.1. The SELLER shall provide the service as described in the booking, with vehicles holding the required permits and insurance and with professional drivers.
6.2. The BUYER confirms that the name, contact, flight and address details given during booking are correct and complete. The SELLER cannot be held responsible for problems caused by incorrect or missing information.
6.3. The BUYER is responsible for ensuring that the number of passengers and amount of luggage suit the selected vehicle. If they exceed the vehicle's capacity, the SELLER may decline to perform the service for safety reasons.
6.4. Traffic and safety rules must be followed. The BUYER and accompanying passengers must wear seat belts and follow the driver's safety instructions.
7. Cancellation and Refunds
7.1. The BUYER may cancel the booking before the service time through the link sent by email or WhatsApp, or by contacting the SELLER's customer service.
7.2. For cancellations made before the service time, the full amount paid is refunded to the BUYER.
7.3. Card payments are refunded to the card used for payment within 14 days of the cancellation at the latest. How long the refund takes to appear on the card account depends on the bank.
7.4. For bookings paid in cash, no payment is collected before the service, so no refund is needed.
7.5. For services not performed for reasons attributable to the BUYER under clause 5.4 (no-show), the price is not refunded.
7.6. If the service cannot be provided for reasons attributable to the SELLER, the full amount paid is refunded to the BUYER.
8. Right of Withdrawal
Under Article 15(g) of the Regulation on Distance Contracts, the right of withdrawal does not apply to contracts for services that must be provided on a specific date or within a specific period. The SELLER nevertheless offers free cancellation before the service time under the conditions in clause 7.
9. Force Majeure
The SELLER cannot be held responsible if it is unable to perform the service on time or at all because of events beyond the parties' control, such as natural disasters, epidemics, war, terrorism, strikes, extreme weather, decisions of public authorities or road closures. In that case the amount paid by the BUYER is refunded as described in clause 7.3.
10. Personal Data
The BUYER's personal data is processed in accordance with Turkish Personal Data Protection Law No. 6698 for the purpose of performing the booking. Details are in the data protection notice on the website.
11. Dispute Resolution
For disputes arising from this agreement, the Consumer Arbitration Committees at the BUYER's place of residence or where the service was purchased have jurisdiction within the monetary limits announced each year by the Ministry of Trade; above those limits, the Consumer Courts have jurisdiction. The BUYER may first send complaints to the SELLER using the contact details above.
12. Entry into Force
The agreement is concluded when the BUYER confirms at the payment step that they have read and accept this agreement and the Preliminary Information Form, and completes the booking. The SELLER keeps the agreement electronically, and it is always available on the website.
